Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Zively mobile application and zively.app (collectively, the "Service") operated by Zively ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Zively. If you are under 18, you represent that you have permission from a parent or guardian. You may not use the Service if you are barred from doing so under applicable law.
2. Your account
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at calvin@csenda.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.
3. The Service
Zively lets users discover and broadcast live video streams tagged to general geographic areas. Features may change over time. We do not guarantee uninterrupted availability, error-free operation, or that any particular stream will remain available.
4. Location and privacy
Zively requests location access only while you are using the app. We do not track your location in the background. Other users see neighborhood- or place-level labels for streams — not your exact address. See our Privacy Policy for full details.
5. User-generated content
You retain ownership of content you create (live streams, chat messages, profile information, etc.). By posting content on Zively, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content solely to operate, promote, and improve the Service. This license ends when content is deleted, except where retention is required by law or legitimate backup/archival practices.
You represent that:
- You have the right to post your content
- Your content does not violate any third-party rights
- Your content complies with these Terms and applicable law
6. Acceptable use
You agree not to:
- Stream or share illegal, harmful, harassing, hateful, sexually exploitative, or violent content
- Invade others' privacy, dox, or share others' precise location without consent
- Impersonate any person or entity or misrepresent your affiliation
- Spam, manipulate engagement, or use bots or automated systems without permission
- Attempt to hack, reverse engineer, or disrupt the Service
- Circumvent safety, moderation, or access controls
- Use the Service for any unlawful purpose
We may remove content, restrict features, or terminate accounts that violate these rules. Use in-app reporting tools when you see violations.
7. Safety, blocking, and moderation
Zively provides in-app tools to help you control your experience and report problems:
- Block users. Blocking is one-way: blocked users cannot interact with you in discovery, live streams, chat, or follows. You can manage blocked accounts under Settings → Blocked users.
- Report content. You can report a live stream, a user profile, or an individual chat message. Reports are reviewed by our moderation team — they are not sent directly to the person you reported.
- Host chat tools. Stream hosts can remove chat messages and ban participants from chat for that stream.
- Automated checks. We apply basic automated filters (for example, disallowed links and profanity) on chat. Automated systems may make mistakes; human review is available for reports.
- Enforcement. We may warn, suspend, or permanently ban accounts that violate these Terms or our community standards.
Submitting false or abusive reports may result in action against your account. For urgent safety concerns, contact calvin@csenda.com in addition to using in-app reporting.
8. Live streaming risks
Live streaming involves real-time public or semi-public broadcast. You are solely responsible for what you stream and for complying with local laws (including filming restrictions, music licensing, and event rules). Do not stream while driving or in situations where broadcasting creates safety risks.
9. Third-party services
The Service integrates third-party providers (including Supabase, Agora, Google Maps, and sign-in providers). Your use of those services may be subject to their terms and policies.
10. Intellectual property
Zively's name, logo, app design, and underlying technology are owned by us or our licensors. These Terms do not grant you any rights to our trademarks or brand except as needed to use the Service.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, create risk or legal exposure, or if we discontinue the Service. Provisions that by nature should survive termination will survive (including licenses granted for operational purposes, disclaimers, and limitations of liability).
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Content posted by users is the responsibility of the person who posted it. We are not responsible for user conduct or user-generated content.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZIVELY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM (IF ANY).
14. Indemnification
You agree to indemnify and hold harmless Zively from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.
15. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence apply.
16. Changes
We may update these Terms from time to time. Continued use after changes become effective constitutes acceptance. If you do not agree to updated Terms, stop using the Service.
